Strange Law Makes It Impossible For Couple To Get Justice For Their Young Child

Because of a Court of Appeals ruling in Oregon, that states that victims must be able to “describe their attack,” parents of a one-year old baby boy are left in disbelief.

Last May, an extremely sad, extremely heartbreaking and extremely infuriating story about Jacob Marbury circulated social media. The infant was in the care of his father’s best friend while he and the mother went on a date. When the parents returned home they found their young son screaming in agony while the “babysitter” was sound asleep on the couch.

The next morning Alicia Quinney and Joshua Marbury noticed purple and blue marks covering Jacob’s body, including a noticeably large handprint on his face. They immediately confronted Markell Deon Hilaire, the man they left in charge and who had been living with the couple. After first denying direct involvement he later confessed to beating the child- for reasons still unknown.

But what happened next is by far the most shocking. After waiting for over two months for official charges to be filed the couple were notified that the charges had been dropped, due to a loophole in the judicial system.

According to Oregon law, since Jacob is unable to voice the details of the abuse or express his suffering through words, Hilaire was not charged. The parents were left with no other option but to take to Facebook to share their story in hopes of attracting widespread attention and ultimately changing the court’s minds.

I normally keep my matters with family very private cause i dont need the attention. But this is different. TWO months ago if not longer my 1 year old son was smacked across the right side of his face by our babysitter (keep this person anonymous) to the point where MULTIPLE doctors (who in fact showed us hand prints) and the detective said it could have killed him.

After several days if not week of being distracted at my job (only commission sales job and only source of income) we had a confession from the abuser saying they did it. STILL this person was not arrested because they had to build a case and a jury to find him guilty BEFORE they go to jail. Side note if im not mistaken (if i strike a person in the face and the cops were called i would be put in hand cuffs immediately).

After TWO months of waiting we only find out that charges are dropped BECAUSE my one year old cannot tell you verbally he was abused and my son did not show he was in pain OR that this person “intentionally” did this. I am SO furious that im not using profanity HOPING something is done and this goes viral. I did my part with GOD and your “advise” to not recourse to my own action with revenge. DO YOUR PART, you have a verbal confession and evidence showing a hand print!!!! A dead body cant tell you who killed them. Yet a baby isnt held to the same standard because he cant talk???? Well neither can a dead body. THATS BLASPHEMY.

You waited 2 months if not longer to tell us this???? Something needs to be done. NOBODY can just hit a child and more to just get away with it because the child cant verbally tell you. Quinney, who was told by a Washington County Deputy District Attorney that “pets are better protected than children” and provided with a source to the publication, is challenging that rule.

After gaining Worldwide attention from their story a petition to overturn the law has amassed more than 55,000 signatures- sign the petition here and a GoFundMe page has been started to help with court costs.

Since Marbury’s post, Jacob’s abuser is facing three felony charges, each carrying a maximum punishment of five-years in prison. And although Hilarie’s aunt is arguing, in his defense, that her nephew was drunk at the time and is partially blaming the parents, this does NOT excuse his behavior.

The final ruling has not yet been made but let’s hope and pray justice is served for this sweet baby boy.
